           L'ESPACE DE LIBERTÉ, DE SÉCURITÉ ET DE JUSTICE
        20 ANS APRÈS LE CONSEIL EUROPÉENNE DE TAMPERE

    Les 15 et 16 octobre 1999, à Tampere, la réunion extraordinaire du Conseil européen a jeté
les bases de la création d'un Espace européen de liberté, de sécurité et de justice (ELSJ) qui,
depuis le Traité de Lisbonne, constitue un objectif prioritaire pour l'Union européenne dans la
réalisation du marché intérieur.
    Faisant partie intégrante de la libre circulation des personnes et assurant un niveau élevé
de protection des citoyens, l'ELSJ couvre un large éventail de domaines, tels que la coopération
judiciaire en matière civile et pénale, la lutte contre le terrorisme et la criminalité, le contrôle
aux frontières, les politiques d'asile et d'immigration. Elle s'articule autour d'un trinôme de
"principes-valeurs" qui constituent ses éléments constitutifs de valeur égale, mais qui, par leur
nature même, peuvent s'opposer, ce qui impose une activité de rééquilibrage constant en
raison notamment du plein respect des droits fondamentaux qui, avec le respect des différents
systèmes et traditions juridiques des États membres, constituent un élément essentiel pour la
réalisation de l’espace même.
    Le vingtième anniversaire du Conseil de Tampere est l'occasion de mobiliser la communauté
scientifique dans une vaste réflexion sur le développement, les réalisations (partielles) et les
questions critiques qui caractérisent – entre les composantes "intergouvernementales" et
"supranationales" – l’ambitieux projet lato sensu politique qui constitue le fondement de l'ELSJ.
    Par conséquent, le présent appel à contributions invite les spécialistes du domaine à
contribuer – soit par des réflexions générales, soit en proposant des travaux spécifiques
approfondis sur les thèmes ci-dessus ou sur d'autres aspects non explicitement mentionnés –
à la création de deux éditions thématiques de la revue “Freedom, Security & Justice: European
Legal Studies” (n° 1 et n° 2/2019).
    Pour participer à la sélection, une contribution (pas plus de 20 pages) en italien, anglais,
français ou espagnol rédigée selon les critères éditoriaux (publiés dans
http://www.fsjeurostudies.eu/criteri-redazionali.html) doit être envoyée à l'adresse e-mail
slsg@unisa.it au plus tard le 20 janvier 2019. En même temps, le nom, le prénom et l'adresse
électronique de l'auteur, l'institution à laquelle celui-ci est affilié (le cas échéant) doivent être

communiqués ainsi qu’un bref curriculum vitæ. Les contributions reçues feront l'objet d'un
    double blind peer review et le résultat de la sélection sera communiqué au plus tard le 25 février
    2019 à l'adresse électronique indiquée.
        Les auteurs des contributions les plus originales et les plus innovatrices seront aussi invités
    à participer, en qualité d'orateurs, à une Conférence internationale qui se tiendra en octobre
    2019 à l'Université de Salerne, en collaboration avec l’Observatoire sur l’espace européen de
    liberté, de sécurité et de justice et la Jean Monnet Chair “Judicial Protection of Fundamental
    Rights in the European Area of Freedom, Security and Justice”. L'organisation prendra en
    charge la nourriture et l'hébergement (pour 1 nuit) et les frais de déplacement (dans la limite
    de 150,00 euros).

                                           CALL FOR PAPERS
 THE AREA OF FREEDOM, SECURITY AND JUSTICE AFTER TWENTY YEARS
            FROM THE EUROPEAN COUNCIL OF TAMPERE

     The special meeting of the European Council held on 15 and 16 October 1999 in Tampere laid the
basis for the creation of an Area of Freedom, Security and Justice (AFSJ), which after the entry into
force of the Treaty of Lisbon became a priority objective of the European Union over the creation of
the internal market.
     Being aimed at ensuring the free movement of persons and enhancing the protection of the
citizens residing in the EU, the AFSJ includes a wide range of fields of action, such as judicial
cooperation in civil and criminal matters, fight against crime and terrorism, border control, asylum
and migration policies. The AFSJ is based on three core principles-values that, on the one hand, are
granted equal importance, but, on the other, can potentially enter into conflict. This requires the
European legislator to strike an ongoing balance between them in order to ensure the full protection
of fundamental rights, which – together with the respect of the Member States’ legal orders and
national identities – represents an essential element for the same implementation of the Area of
Freedom, Security and Justice.
     The twentieth anniversary of the Tampere Council provides the opportunity to engage the
academic community in a thorough discussion on the developments, the (partial) achievements and
the critical issues that still characterise – between “intergovernmental” and “supranational” features
– the ambitious and broadly political project underlying the AFSJ.
     This call for papers is addressed to all the scholars who investigate the described topics with the
aim of contributing – with studies having either a more general nature or an in-depth perspective on
the above mentioned policies or other relevant aspects – to two special issues of the Journal
“Freedom, Security & Justice: European Legal Studies” (n. 1 and n. 2/2019).
     Interested applicants are kindly invited to send their papers to the e-mail address slsg@unisa.it
by the deadline of 20 January 2019. Papers can be written in Italian, English, French or Spanish, shall
be no longer than 20 pages, and drafted according to the editorial guidelines of the Journal (available

at http://www.fsjeurostudies.eu/criteri-redazionali.html). Papers shall also carry name, surname, e-
mail address and affiliation of the Author, as well as a short CV shall be provided.
    Papers will undergo a double-blind peer review process, whose results will be notified via e-mail
to the applicants by 25 February 2019.
    The Authors of the most original and innovative papers will be also invited to participate as
speakers in the International conference that will be held in October 2019 at the University of Salerno
in collaboration with the Observatory on the European Area of Freedom, Security and Justice and
the Jean Monnet Chair “Judicial Protection of Fundamental Rights in the European Area of Freedom,
Security and Justice”. The University of Salerno will cover the selected speakers’ hotel
accommodation for one night and travel expenses (up to 150,00 euros).

               LO SPAZIO DI LIBERTÀ, SICUREZZA E GIUSTIZIA
          A VENT’ANNI DAL CONSIGLIO EUROPEO DI TAMPERE

    Il 15 e 16 ottobre 1999, a Tampere, la riunione straordinaria del Consiglio europeo ha
gettato le basi per la creazione di uno Spazio europeo di libertà, sicurezza e giustizia (SLSG) che,
con il Trattato di Lisbona, è divenuto obiettivo dell’Unione europea prioritario rispetto alla
creazione di un mercato interno.
    Funzionale alla libera circolazione delle persone e alla garanzia di un elevato livello di
protezione dei cittadini, lo SLSG comprende una pluralità di settori, quali la cooperazione
giudiziaria in materia civile e penale, il contrasto al terrorismo e alla criminalità, il controllo delle
frontiere, le politiche di asilo e immigrazione. Esso è strutturato su un trinomio di “principi-
valori” che assurgono a suoi elementi costitutivi di pari valenza ma per loro natura in potenziale
contrapposizione; ne deriva un’attività di costante bilanciamento anche in ragione della piena
garanzia dei diritti fondamentali che – unitamente al rispetto dei diversi ordinamenti giuridici e
delle differenti tradizioni giuridiche degli Stati membri – rappresenta elemento imprescindibile
per la realizzazione dello stesso Spazio di libertà, sicurezza e giustizia.
    La ricorrenza dei vent’anni dal Consiglio di Tampere rappresenta l’occasione per coinvolgere
la comunità scientifica in un’ampia riflessione sullo sviluppo, le (parziali) realizzazioni e le
criticità che connotano – tra componenti “intergovernative” e componenti “sovranazionali” –
l’impegnativo progetto lato sensu politico sottostante allo SLSG.
    Pertanto, con il presente call for papers si invitano gli studiosi della materia a contribuire –
sia attraverso riflessioni di carattere generale, sia proponendo approfondimenti specifici sugli
argomenti sopra contemplati o su ulteriori aspetti non esplicitamente citati – alla realizzazione
di due numeri tematici della Rivista “Freedom, Security & Justice: European Legal Studies” (n. 1
e n. 2/2019).
    Per partecipare alla selezione occorrerà inviare all’indirizzo e-mail slsg@unisa.it, entro e non
oltre il 20 gennaio 2019, un contributo (non superiore alle 20 pagine) in lingua italiana, inglese,
francese       o     spagnola      conforme        ai     criteri   redazionali      (pubblicati       in
http://www.fsjeurostudies.eu/criteri-redazionali.html). Contestualmente, dovranno essere
comunicati il nome, il cognome e l’indirizzo e-mail dell’Autore, l’(eventuale) Istituzione di

appartenenza e dovrà essere inviato un breve curriculum vitae. I contributi pervenuti saranno
    soggetti ad un processo di double-blind peer review e l’esito della selezione sarà comunicato
    entro il 25 febbraio 2019 all’indirizzo e-mail indicato.
        Gli Autori dei contributi connotati da maggiore originalità ed innovatività saranno, altresì,
    invitati a partecipare, in qualità di relatori, ad un Convegno internazionale che sarà organizzato
    nel mese di ottobre 2019 presso l’Università degli Studi di Salerno, in collaborazione con
    l’Osservatorio sullo Spazio europeo di libertà, sicurezza e giustizia e la Cattedra Jean Monnet
    “Judicial Protection of Fundamental Rights in the European Area of Freedom, Security and
    Justice”. L’organizzazione si farà carico delle spese di vitto e alloggio (per 1 notte) e di viaggio
    (entro il limite di Euro 150.00).

                            LLAMADA A CONTRIBUCIONES
            EL ESPACIO DE LIBERTAD, SEGURIDAD Y JUSTICIA
     A LOS VEINTE AÑOS DEL CONSEJO EUROPEO DE TAMPERE

    El 15 y 16 de octubre de 1999, en Tampere, la reunión extraordinaria del Consejo Europeo
puso las bases para la creación de un Espacio Europeo de Libertad, Seguridad y Justicia (EELSJ)
que, con el Tratado de Lisboa, se convirtió en un objetivo de la UE, prioritario respecto a la
creación de un mercado interno.
    Funcional a la libre circulación de personas y a la garantía de un nivel elevado de protección
de los ciudadanos, el Espacio Europeo de Libertad, Seguridad y Justicia comprende múltiples
sectores, como la cooperación judicial en materia civil y penal, la lucha contra el terrorismo y
la criminalidad, el control de las fronteras, la política de asilo e inmigración, etc. Se estructura
en tres “principios-valores” que se configuran como elementos constitutivos que tienen la
misma importancia pero que, por su propia naturaleza, son potencialmente contrapuestos;
eso impone una actividad de equilibrio constante, también en razón de la plena garantía de los
derechos fundamentales que – junto con el respeto de los diferentes ordenamientos y
tradiciones jurídicas de los Estados miembros – representa un elemento imprescindible para la
realización del Espacio Europeo de Libertad, Seguridad y Justicia.
    El veinte aniversario del Consejo Europeo de Tampere supone una ocasión para convocar a
la comunidad científica para una amplia reflexión sobre el desarrollo, las (parciales)
realizaciones y la crítica que connotan –entre componentes “intergubernamentales” y
componentes “supranacionales” – el difícil proyecto, lato sensu político, que subyace al Espacio
Europeo de Libertad, Seguridad y Justicia.
    Por lo tanto, con la presente llamada a comunicaciones se invita a los investigadores en esa
materia a contribuir –tanto a través de reflexiones de carácter general como proponiendo
profundizaciones específicas sobre los temas aludidos o sobre otros aspectos no explícitamente
citados – para la realización de dos números temáticos de la Revista “Freedom, Security &
Justice: European Legal Studies” (n. 1 y n. 2/2019).

Para participar en la selección habrá que enviar al correo electrónico slsg@unisa.it, antes
    del 20 de enero de 2019, un texto (que no exceda las 20 páginas) en italiano, inglés, francés o
    español según los criterios de redacción publicados en < http://www.fsjeurostudies.eu/criteri-
    redazionali.html>. En el mismo correo habrá que comunicar los datos personales del autor
    (nombre, apellidos, correo electrónico, eventual institución de pertenencia) y un breve
    curriculum vitae. Las contribuciones serán sometidas a un proceso de doble revisión ciega y el
    resultado de la selección será comunicado antes del 25 de febrero de 2019 en el correo
    indicado por el autor.
        Se invitará a los autores cuyas aportaciones sean consideradas más originales y novedosas
    a participar como ponentes en un Congreso internacional que tendrá lugar en octubre de 2019
    en la Universidad de Salerno, en colaboración con el “Osservatorio sullo Spazio europeo di
    libertà, sicurezza e giustizia” y la Cátedra Jean Monnet “Judicial Protection of Fundamental
    Rights in the European Area of Freedom, Security and Justice”. La organización se hará cargo
    de los gastos de comida y alojamiento (para una noche) y contribuirá a los gastos de viaje (por
    un máximo de 150,00 €).
