Township of Champlain Zoning By‐Law 2000‐75
February 11th 2021

Public Meeting
    This public meeting is a requirement of the Planning Act and is being held to provide an opportunity
     for the public to voice their comments and concerns with regards to the proposed amendment to the
     Zoning By-Law.

    If a person or public body would otherwise have an ability to appeal the decision of the Township of
     Champlain to the Local Planning Appeal Tribunal (LPAT) but the person or public body does not make
     oral submissions at a public meeting or make written submissions to the Township of Champlain
     before the by-law is passed, the person or public body is not entitled to appeal the decision.

    A person or public body may not be added as a party to the hearing of an appeal before the Local
     Planning Appeal Tribunal unless, in the opinion of the Board, there are reasonable grounds to do so.

Application Scope

   •   The zoning by-law amendment affects municipally known as 3975-3977 Highway 34 with the
       legal description CON 3 PT LOT 10 46R6580; PARTS 1 AND 2 with the following Roll
       Number 0209.006.003.02630 in the former Town of West Hawkesbury now in the Township
       of Champlain, as shown on the Map below. The subject site is within the ‘Rural Policy Area’
       of the United Counties of Prescott and Russell Official Plan (UCPR).

   •   The zoning by-law amendment proposes to change the zoning category for 3975 Highway 34
       from Rural Special Exception Zone (RU-23) to Rural Special Exception Zone (RU-23). The
       zone change is requested in order to allow for a semi-detached development with two
       accessory dwelling units.

Analysis
Provincial Policy Statement (2020)

The 2020 Provincial Policy Statement provides clear policies for rural lands.

1.1.5.1 When directing development on rural lands, a planning authority shall apply the
relevant policies of Section 1: Building Strong Healthy Communities, as well as the
policies of Section 2: Wise Use and Management of Resources and Section 3: Protecting
Public Health and Safety.

Analysis
Provincial Policy Statement (2020)

1.1.5.2 On rural lands located in municipalities, permitted uses are:

a) the management or use of resources;
b) resource-based recreational uses (including recreational dwellings);
c) residential development, including lot creation, that is locally appropriate;
d) agricultural uses, agriculture-related uses, on-farm diversified uses and normal farm
practices, in accordance with provincial standards;
e) home occupations and home industries;
f) cemeteries; and other rural land uses.

Analysis

Official Plan

Schedule ‘A’ of the United Counties of Prescott and Russell Official Plan designates the
subject lands as part of the as “Rural Policy Area”.

• As per section 2.5.2 The Rural Policy Area is composed of lands which are located
  outside of the primary development and agricultural resource areas, that is to say
  lands which are outside of the Urban Policy Area and Community Policy Area and
  the Trade and Industry Policy Area and the Agricultural Resource Policy Area. As
  per schedule E of the Official Plan, Aggregate Resources are located on both sides
  of the property.

Analysis
Official Plan

• 7.6.3.2 The County encourages the permission of second residential units within all
  single detached, semi-detached, and townhouses dwelling units. If an accessory
  dwelling unit is not located in the principal dwelling unit, then the second residential
  unit may be within an accessory structure on the property. Local municipal official
  plans and implementing zoning by-laws will contain detailed policies and
  requirements relating to second residential units which shall be implemented “as of
  right” provided they are compliant with other relevant provincial requirements.

 The Existing Special Exception Zone (RU-23):

 Notwithstanding the provisions of Section 11.1(a) hereof to the contrary, on the land
 zoned RU-23, a semi-detached dwelling or a duplex dwelling shall be an additional
 permitted use. The zone requirements of Section 11.1(b)(iii) shall apply to such use
 except that the minimum floor area requirement will apply to each dwelling unit and the
 maximum number of dwelling units per lot shall be 2.

Township of Champlain Zoning By‐Law

 Notification
  •   The application to amend the Township of Champlain Zoning By-Law 2000-75 was received on
      December 17th 2020. The proposed Zoning By-law Amendment was circulated internally within the
      Township of Champlain and on January 12th 2021.

  •   A Notice of Application and Notice of Public Meeting was sent to property owners at 120 meters, to the
      agencies prescribed by the Planning Act and published in the newspapers.

  •   Administration has not received comments from adjacent neighbours..

Next Steps
• There will be a 20 day appeal period as prescribed by the Planning Act following the notice
  of the decision and the passing of the amending bylaw.

• If you wish to be notified of the decision of the municipal council, you must make a written
  request addressed to the Clerk, Township of Champlain 948 East, Pleasant Corner Road
  Vankleek Hill (Ontario) K0B 1R0.
