Articles L. 6352-3 ff. of the French Labo r Code [ Code de tra ail ], per their ording
follo ing La no. 2018-771 of 5 September 2018 pertaining to the freedom to
choose one s professional f t re.

The define the reg lations in place at the Fontaineblea School of Acting (hereafter
FONACT ) regarding health, safet and sec rit and h giene. Their p rpose is also to
set o t general and permanent r les and reg lations related to discipline, as ell as
the nat re and scale of disciplinar meas res that can be taken as regards st dents.

An bod participating in a FONACT acti it that ser es to de elop his or her skills is
req ired to obser e these internal r les for the d ration of the acti it being
 ndertaken.

Where training takes place in an establishment for hich internal r les are alread in
place, the health, safet and sec rit meas res that appl to st dents are those of
that establishment s internal r les.

All st dents are s bject to the internal r les set o t in this doc ment prior to their
official registration.

All indi id als in ol ed in FONACT acti ities are req ired to beha e in s ch a a that
ens res that basic manners and social con entions are respected, and, more
broadl , that goods and people are respected, so as to ens re, for the good of all,
that the training r ns smoothl .

No beha io r shall pose a threat to p blic order or the smooth r nning of FONACT.

   especiall  ith regard to the se of reso rces that ha e been made a ailable.

E er st dent m st ens re his or her personal safet and sec rit , and that of
others, b follo ing the general and specific instr ctions pertaining to h giene and
safet and sec rit . Pre enting an risk of accident means keeping an reso rces
made a ailable in the conte t of the co rse in orking order and in good condition.

req ired to alert the FONACT management to it immediatel .

2.1. Fire proced res
Fire proced res, and specificall maps indicating the location of fire e ting ishers
and emergenc e its, are displa ed at FONACT premises. St dents sho ld familiarise
themsel es ith them.

2.2. Alcoholic drinks and dr gs
Bringing an form of dr g or alcoholic drink onto the premises or cons ming an
form of dr g or alcoholic drink on the premises, is formall prohibited. St dents are
prohibited from entering or sta ing on an premises hile dr nk or nder the
infl ence of dr gs.

strictl prohibited. Non-adherence to this r le ma gi e rise to criminal sanctions, in
additional to the disciplinar meas res set o t in these internal r les.

2.3. Ban on smoking
Per Decree no. 2006-1386 of 15 No ember 2006, smoking is formall prohibited,
specificall in an closed or co ered areas that are open to the p blic or that
constit te orkplaces, as ell as in establishments designed to pro ide training.

As a res lt, smoking and aping (the se of electronic cigarettes) is prohibited in
training rooms and more generall  ithin FONACT.

2.4. Acciden s
An st dent ho s ffers an accident d ring training or hile tra elling bet een the
training site and his or her accommodation or orkplace, or ho itnesses s ch an
accident, shall immediatel alert the FONACT management to it.

The FONACT representati e shall carr o t the necessar health-and-safet
meas res and dra p a declaration for the rele ant social-sec rit department.

2.5. Loss or hef
Personal goods and effects are nder the sole s per ision and responsibilit of their
o ners. n case of loss or theft, FONACT shall not be held responsible for an
detrimental conseq ences that th s arise.

To pre ent problems, st dents are req ested not to lea e their personal effects
 ns per ised and are asked to alert the establishment s management to an
 nkno n indi id als or s spect beha io r.

n case of loss or theft, an necessar administrati e or legal proced res, as carried
o t thro gh the appropriate a thorities, are the responsibilit of the st dent.

2.6. Keeping si es clean and in good condi ion
All st dents commit to keeping all rooms and sites as clean as possible. Eating food
in an co rse room is prohibited, and nder no circ mstances is litter to be left in
them. Damaging the FONACT premises, e en slightl , is prohibited.

3.1. S den a endance
C
St dents sho ld follo the timetable established and sent to them in ad ance b
FONACT.

Not follo ing the timetable ma lead to disciplinar meas res being imposed. E cept
in e ceptional circ mstances, st dents ma not absent themsel es d ring co rse
ho rs.

n case of absence, late arri al or lea ing being anticipated prior to the timetable
established, st dents sho ld alert FONACT and indicate their j stification for the
e ent in q estion.

Where the st dent has a financial-s pport pro ider, FONACT shall immediatel
inform that pro ider (emplo er, management, ocational-training operator, region,
emplo ment centre etc.) abo t the sit ation in q estion.

An e ent that is not j stified b e ceptional circ mstances is liable to inc r
disciplinar meas res. An late arri al or anticipated lea ing sho ld be noted in
  riting on the attendance form so that e act times of arri al and lea ing are detailed.

 n addition, per Article R. 6341-45 of the French Labo r Code, an st dent hose
costs are co ered b p blic a thorities is liable to ha e his or her cost pro ision
red ced in proportion to the d ration of his or her absence.

3.2. Access o raining si e
E cept here e pressl a thorised b the FONACT management, st dents ma not:
    Enter or remain on co rse premises for an reason other than completing the
    co rse.
    Bring in an one not connected to the organisation, ha e an one not in ol ed in
    the organisation bro ght in, or enable an one not connected to the organisation
    to enter.
    Undertake to sell goods or ser ices on co rse premises.

3.3. C
St dents are asked to attend training sessions in appropriate clothing, hich m st
not, nder an circ mstances, pose a threat to the safet or sec rit of goods or
people.

3.4.
Unless specificall a thorised other ise b the FONACT management, training
reso rces and eq ipment are to be sed at co rse premises and are to be emplo ed
solel in connection ith training acti ities. The se of reso rces for personal ends is
prohibited.

St dents are req ired to ens re that an reso rces or eq ipment to hich the ha e
access d ring the training are kept in good condition. St dents sho ld se reso rces
according to their p rpose and in keeping ith the r les e plained b co rse leaders.

St dents sho ld immediatel alert co rse leaders to an anomal                                      ith respect to
reso rces or eq ipment.

3.5. B
An FONACT ed cational material pro ided to st dents for an                                      p rpose is an
intellect al prod ct protected b intellect al-propert la .

Under no circ mstances ma st dents reprod ce, share, or loan an ed cational
material or an doc ments related to co rse content for, ith or to an other
ph sical or legal person itho t FONACT s prior ritten appro al.

4. D

4.1. P ni i e disciplinar meas res
Sho ld the st dent fail to meet an of the terms of these internal r les in an a , he
or she ma be s bject to a p niti e meas re as iss ed b the FONACT representati e
or someone acting on his or her behalf.

An act deemed an instance of rongdoing ma , in keeping ith its nat re and
se erit , be s bject to one or more of the follo ing p niti e meas res:

   Req est to change beha io r; call to order.
   Written notice from the Director of FONACT or his representati e.
   Formal arning.
   Temporar e cl sion from training.
   Permanent e p lsion from training.

An act deemed an instance of rongdoing prompting a temporar e cl sion ith
immediate effect as a ital protecti e meas re not ithstanding, no permanent
p niti e meas re related to that act ma be implemented itho t the st dent being
informed in ad ance of the complaints bro ght against him or her, and potentiall
  itho t the proced re described belo being follo ed.

S mmons o a mee ing
Where the Director of FONACT or his representati e intends to impose a p niti e
meas re, the follo ing proced re shall be follo ed:

   S mmons of the st dent, b registered post ith a req est for ackno ledgement
   of receipt or deli ered to him or her against receipt.
   Notice of the p rpose of the s mmons, as ell as the date, time and location of
   the meeting, as       ell as mention of the possibilit of the st dent being
   accompanied b a person of his or her choice (fello FONACT co rse st dent or
   other ise).

Possible accompanimen d ring mee ing
D ring the meeting, the st dent ma be accompanied b a person of his or her
choice; the st dent delegate, for e ample.

The Director or his representati e shall e plain the reason for the intended p niti e
meas re and shall note the st dent s e planations.

 ss ing of he p ni i e meas re
The p niti e meas re ma be imposed no less than one orking da and no more
than t o eeks after the meeting. The p niti e meas re shall req ire ritten
notification, hich incl des an reasons for it, being made to the st dent in the form
of a registered letter or deli er against receipt.

5. S

5.1. H
A reg lar delegate and a s bstit te delegate shall be elected at the same time, ia a
 ninominal t o-ro nd oting process, according to the follo ing conditions:

       All st dents ma ote and are eligible. The ote shall take place d ring co rse
       ho rs, at the earliest t ent ho rs and at the latest fort ho rs after the co rse
       begins.
       The FONACT representati e shall o ersee the ote. He or she shall be responsible
       for it being r n fairl . He or she shall send a statement of fail re to elect to the
       Prefect of the region ith a thorit o er the area sho ld st dent representation
       not be possible.
       The first ro nd of oting req ires an absol te majorit . n the second ro nd of
        oting, a relati e majorit s ffices.

5.2. D
Delegates are elected for the d ration of the acti it .

Their f nctions come to an end hen the finish, for an reason hatsoe er,
participating in the training. f the reg lar delegate and the s bstit te delegate cease
their f nctions before the training ends, a ne election shall take place.

5.3. R
The delegates make s ggestions related to impro ing ho                              the co rses are r n and
st dents e periences at FONACT.

The present all indi id al and collecti e req ests pertaining to these matters,
h giene and safet and sec rit conditions, and the application of the internal r les.

6. P
Personal data s pplied b st dents ma be s bject to comp ter processing                                                ith a
 ie to ens ring the effecti e r nning of the co rse.

St dents personal data shall be stored according to appropriate strategies and
methods for ens ring its sec rit .

1 N ROD C ON & P RPOSE
1.1 The School s j risdiction nder this Code is not limited to its o n premises. The
Code incl des miscond ct occ rring in an place to hich a st dent is g aranteed
access b irt e of their stat s as a st dent. This o ld, therefore, incl de e ternal
engagements, placements incl ding clinical placements, comm nit /school
e periences, and o tside performances and recitals.

1.2 The St dent Disciplinar Proced re is intended to pro ide a clearl form lated
and impartial process for dealing ith allegations relating to st dent discipline or
beha io r ithin a reasonable timescale ha ing d e regard to the spirit of nat ral
j stice.

1.3 FONACT reser es the right to terminate attendance ith immediate effect if the
FONACT team deems a st dent nfit to complete the programme. This polic applies
to all st dents at FONACT. The performance re ie process is in the best interest of
staff and st dents to protect them thro gho t their time at FONACT.

1.4 S DEN PERFORMANCE
    FONACT recognises the demands of st d pon st dents and that an indi id al
    st dent at a partic lar time ma e perience diffic lties. The re ie process is
    necessar to respond hen a st dent is e periencing diffic lt               hich ma be
    related to health, personal, academic, professional or other challenges ith the
    aim of pro iding s pport and ad ice to assist them achie e their academic and
    professional goals.

2 GENERAL COND C
2.1 The School e pects st dents to cond ct themsel es at all times in an orderl
manner, respecting the rights, pri ac and propert of others.

2.2 No st dent shall engage in cond ct hich amo nts to the improper interference,
in the broadest sense ith the proper f nctioning of the School, those ho ork or
st d    ithin it, or its rep tation. S ch interference ill be regarded as miscond ct
and in estigated nder the disciplinar proced re belo ; e amples of the t pes of
beha io r that ill be constr ed as miscond ct are gi en in Appendi a. (The list is
not intended to be e ha sti e.)

2.3 Specific reg lations e ist ith respect to accommodation, and se of School
facilities and eq ipment. St dents are req ired to obser e these reg lations. n
some circ mstances fail re in s ch obser ance ma also res lt in the matter being
p rs ed nder this Code at hich point this Code takes precedence.

2.4 CONTACT DETA LS.
 t is the responsibilit of st dents to keep the School informed of their c rrent home
and term-time addresses, personal email, and mobile n mber at all times hile the
remain members of the School.

2.5 COMMUN CAT ON
The primar method of formal comm nication ith all registered st dents shall be

2.7 Animals are not permitted on School premises, e cept for g ide dogs for disabled
st dents and a thorised isitors, or if req ired in a performance.

not be remo ed itho t proper a thorit . An thing mo ed in contra ention of this
reg lation ma be reco ered itho t notice b a thorised staff. Those responsible
ma be liable for reco er costs.

2.9 No st dent shall ilf ll damage or deface, or rongf ll treat as their o n, an
propert o ned or leased b the School. A st dent ill be req ired to make good in
  hole or in part, to the satisfaction of the School, an damage of this kind that the
ca se, in addition to an other penalt imposed.

2.10 No st dent shall ilf ll damage, or rongf ll treat as their o n, the propert
of an other person on School premises. The School accepts no responsibilit for
pri ate propert lost or damaged on School premises.

2.11 Members of School staff ha e a thorit to check breaches of the r les of
discipline. f a member of staff feels it necessar , the member of staff ma req ire a
st dent, hose cond ct is belie ed to be in breach of this Code, to ithdra from
an room or facilit affected b the cond ct in q estion.

3 M SCOND C
3.1 mproper interference, in the broadest sense, ith the proper f nctioning or
acti ities of the School, or ith those ho ork or st d in the School; or action
  hich other ise damages the School, or action that de iates from accepted
instit tional, professional, academic or ethical standards, ill be regarded as
miscond ct and an infringement of these reg lations.

3.2 Consistent lack of p nct alit for programme acti ities is a matter for in oking
disciplinar proced res.

MA ERS
4.1 Where alleged miscond ct co ld also constit te an offence nder the criminal

proceedings ma be dela ed ntil s ch time as the police and/or co rts ha e
completed their in estigations and proceedings. Ho e er, the School reser es the
right to proceed ith a disciplinar case here it feels it has s fficient information to
do so itho t aiting for the completion of the police in estigation.

4.2 Where a st dent has also been con icted and sentenced b a criminal co rt in
respect of the same facts, the findings of the co rt and the penalt set ill be taken
into consideration at an hearing cond cted b the School.

4.3 Where a st dent has been iss ed ith a formal police ca tion, the ca tion                                       ill be
taken into consideration at an hearing cond cted b the School.

5 D SC PL NAR PROCED RE O ER E
5.1 The Director has ltimate responsibilit for all matters of st dent discipline. The
Director ma delegate their po ers nder this Code to the Operations Office either
generall or in a partic lar case. n the case of informal action this delegation ma
also incl de the Programme Leader or Operations Office. Reference in this Code to
the Director sho ld also be read as a reference to their designated dep t .

5.2 An complaint abo t the cond ct of a st dent, hether made b a member of
staff or b a member of the p blic, or b one st dent abo t another, shall be
considered in the light of the r les laid do n in this Code. Ho e er, allegations from
parents, relati es or friends, on behalf of a st dent ho chooses not to make an
allegation themsel es, cannot be p rs ed nder this Code (e cept here the st dent
concerned is a minor).

5.3 Where a complaint has been made, the Director ma r le that it sho ld not be
s bject to f rther action nder this Code.

5.4 f the Director (or nominee) considers that action is required, the shall e ercise
their discretion to determine hether the formal or informal procedure is to be
used. The Director s decision on ho to proceed shall be final. The student ill be
given a cop of this Code and procedure.

5.5 f more than one student has been accused of the same or substantiall similar
conduct, then the authorised officer shall decide hether the cases of all or an of
the students shall be investigated and/or heard together.

5.6 The School abides b the principles of natural justice and in the conte t of this
Code, the follo ing applies. Students ill:

   be presumed to be innocent of an allegation or charge until the contrar is
   proved on the balance of probabilities;
   be made full a are of the nature of allegations made against them;
   be given an opportunit to repl to an allegations and to be accompanied;
   be given a fair and unbiased hearing before a Student Disciplinar Committee, at
    hich all relevant circumstances can be taken into account;
   have the right to appeal against an decision of the Student Disciplinar
   Committee hich involves suspension, e clusion or e pulsion.

5.7 The operation of informal procedures is underpinned b the follo ing principle:
that here allegations of misconduct are of a minor nature it is desirable to address
these, here appropriate, as close as possible to the source of the alleged offence.

5.8 nformal procedures are to be used for minor acts of misconduct and the
follo ing actions can be taken:
a) Dismissal of the case.
b) Verbal arning ith a requirement to desist from an further such action.
c) Written arning reprimanding the student; a cop of the arning to lie on file for
the duration of the
student s period of stud        ith a requirement to desist from an further such
misconduct.
d) A fine and/or restitution of an damage caused b           a of pa ment ith a

e) E clusion from specified activities or facilities
f) Referring the case back for formal process.

5.9 With the informal procedure the Principal ma choose to delegate functions or
da to da responsibilities under their authorit in these matters through the
Operations Office, to the relevant Programme Leader or assistant programme
leader.

Complaints ma be dealt ith in consultation ith an relevant personnel. The
matter ma be referred back to the Operations Office at an stage. Notes of an
action taken and copies of an letters ritten ill be lodged ith the Operations
Office.

5.10 A student ill have 14 da s from the date of the letter informing them of the
outcome of the informal procedure to request to have their case considered under
the formal procedures of the Student Disciplinar Committee instead.

6 FORMAL PROCEDURES
6.1 Formal procedures are to be used for:
a) Repetition of minor acts of misconduct.
b) Where informal action has failed or is considered inappropriate.
c) For serious allegations.

6.2 Such misconduct ma be subject to an of the follo ing measures as ordered b
the Student Disciplinar Committee:
a) Dismissal of the case.
b) Verbal arning ith a requirement to desist from an further such action.
c) Written arning/reprimanding the student; a cop of the arning to lie on file for
the duration of the student s period of stud  ith a requirement to desist from an
further such misconduct.
d) Final ritten arning hich ill remain on the student s file until the have
finished their studies at the School.
e) A fine and/or restitution of an damage caused b           a of pa ment ith a
requirement to desist from an further such misconduct.
f) Suspension here this is defined as a temporar prohibition on attendance.
g) E clusion here there is a partial or selective prohibition on access to School
facilities.
h) E pulsion (this ill be noted permanentl on the student record, and ill be given
as the reason for ithdra al on an transcript or status letter or similar).

6.3 The Committee ill have the absolute discretion to determine the appropriate
measure(s) but in arriving at its decision ill consider the follo ing:
    The nature of the offence, and its impact on an victims ( here relevant)
    The level of intent
    The consequences of the penalt on the student
    The level of insight and responsibilit sho n b the student in respect of their
    actions
    An previous record of misconduct
    The tariff guidelines (see appendi c) Mitigating or e tenuating circumstances.

7 ACT ON & NVEST GAT ON
7.1 The Director shall rel on the Operations Office to instigate action either directl
or through an authorised officer.

7.2 n the circumstances of an allegation the Operations Office ill require a ritten
statement of the allegation from the complainant(s)          ith an evidence or
corroboration available. A police caution ill be accepted as corroboration. This
should also include a statement of desired outcomes here possible and here
appropriate.

7.3 The Operations Office shall provide ritten information to those ho are the
subject of the allegation     of its nature and the anticipated timescale for
investigation.

7.4 The Operations Office ill instigate an investigation of the allegation, securing
further evidence here this is possible.

7.5 The shall be entitled to call for such evidence in                     riting from an relevant part
or e amine an    itnesses to the alleged events.

7.6 f there is no corroborative evidence to the initial complaint then the Operations
Office ill advise all concerned, in riting, of the insecurit of the allegation and the
complaint ill terminate. All records of the case ill be destro ed.

7.7 Where corroboration is available, the Operations Office, or authorised officer, ill
either:
(i) for a minor offence, utilise the informal procedures or
(ii) require the student to attend a meeting of the Student Disciplinar Committee.

8 STUDENT D SC PL NARY COMM TTEE
8.1 The student against hom an allegation is made for hich there is corroboration
available ill be advised in riting of the case against them and provided ith details
of all evidence acquired (a report from the Operations Office). This ill be provided
before the Student Disciplinar Committee meets.

8.2 The student ill be informed of their rights to be heard at a meeting of the
Committee and to be accompanied b a friend. The name of the friend ill be
notified in advance to the Operations Office.

8.3 The student ill be advised of the procedures of the Committee including the
calling of itnesses in support of either the allegation or the student and the
consideration of an  ritten statements/documentation from the student. Where the
student provides a ritten statement/documentation this ill be submitted to the
Operations Office at least three da s before the meeting to enable proper
consideration.

8.4 The Operations Office ill be responsible for convening the meeting of the
Student Disciplinar Committee. The Committee shall normall consist of the
follo ing:
    A member of the Senior Teaching Team (in the Chair)
    A member of the teaching staff not dra n from the student s department and
      ho is independent of the case
    A member of the Operations Team
    A secretar to the Panel ill also be appointed.

8.5 The Committee ill require attendance of the student against hom the
allegation has been made (together ith an friend), ith an               itnesses as
necessar . Ho ever, none of the proceedings outlined in this code and procedure
  ill be invalidated or postponed b reason of the absence of the student provided
that the student has been given ritten notice of the intervie or hearing.

8.6 A formal record    ill be kept of all Disciplinar Committee business.

8.7 At the meeting, the Committee ill intervie the student, receive a report of the
event(s) from the Operations Office and an evidence available and hear the
response of, and receive, an ritten submission from the student.

8.8 The Student Disciplinar Committee ill first determine the facts of the case and
  hether there has been a breach of the Student Code of Conduct. The Student
Disciplinar Committee       ill then consider,    here relevant, an conte tual
information or mitigating circumstances. The student and their friend and an
  itnesses ma be asked to leave the room bet een these t o stages of the
proceedings. The Student Disciplinar Committee ma e ercise its discretion to
adjourn the hearing at an time (for up to one eek) if it feels the need to verif a
fact or summon additional itnesses.

8.9 The Student Disciplinar Committee ill inform the student of its findings and,
  here relevant, its order. An order, or orders, ill be chosen from the list in
paragraph 6.2 ( ith regard to 6.3 and the tariff guidelines in appendi c). The
Committee ill make its decision kno n to the student in riting ithin three
  orking da s of the conclusion of the hearing.

8.10 The records of the case of a student against                          hom charges have been proven
are normall entered on the student s record.

8.11 f the case is dismissed all records of the case                                   ill be absolutel                and
unconditionall destro ed after a period of 6 months.

8.12 All proceedings shall be recorded but remain confidential, but the findings and
order here relevant of the Committee shall be publicised.

8.13 The Committee shall conduct its business in accordance ith a procedure hich
shall accord ith principles of natural justice, but it is not required to observe formal
rules of evidence. t shall be recorded hether or not an decision reached has been
unanimous and it shall be announced if a decision is not unanimous.

8.14 The student shall have the right of appeal to the Student Disciplinar Appeal
Panel against an decision hich involves suspension or e clusion or e pulsion. This
right of appeal does not appl to an suspension/e clusion/e pulsion carried out in
advance of the meeting of the Student Disciplinar Committee.

8.15 There is no right of appeal on an other decision of the Student Disciplinar
Committee.

9.1 f a student ishes to appeal against the decision of the Student Disciplinar
Committee to suspend/e clude or e pel, the must lodge that appeal, in riting, ith
the Operations Office ithin 5 orking da s of the issuing of the Committee s
decision. The grounds for the appeal must be clearl stated; the student should
indicate hether the are appealing against the finding of fact or the order issued or
both, and demonstrate ith supporting documentation that one or both of the
criteria for appeal (see 9.2) appl .

9.2 The Operations Office ill refer the matter to the School Director (or their
nominee) ho ill allo an appeal to be heard if the are satisfied that there is a
prima facie case that either or both of the follo ing criteria appl :
i) that there is ne evidence that could not have been, or for good reason as not,
made available at the time of the hearing;
ii) that evidence can be produced of significant procedural error on the part of the
School before or during the hearing.

9.3 A Student Disciplinar Appeal Committee shall here possible be constituted to
hear the appeal ithin 10 orking da s of the receipt of the appeal.

9.4 The Appeal Committee shall consist of:
    The Director or nominee (in the Chair)
    An associate director or a member of staff from the operations team
    A member of staff or student unconnected to the case nominated b the Chair.
The quorum for the Appeal committee shall be three. A secretar to the Appeal
Committee shall be appointed b the Chair.

9.5 The Appeal Committee shall make no further enquir into matters of fact relating
to the allegation and the evidence, unless ne evidence is forthcoming that could not
have been, or for good reason as not, made available at the time of the original
hearing. The shall have access to the full documentation on the case.

9.6 The appellant ill be informed of their rights to be heard at a meeting of the
Appeal Committee and to be accompanied b a friend. The name of such friend ill
be notified in advance to the secretar to the Appeal Committee.

9.7 The Appeal Committee shall hear the appeal as follo s:
a) The Chair of the Disciplinar Committee, the appellant and an     itnesses as the
Appeal Committee considers appropriate ill present the report of the Student
Disciplinar Committee hich ill include a summar of process, evidence, and
conclusions and decisions together ith all papers associated ith the case;
b) The appellant (and/or friend) ill have the opportunit to address the Appeal
Committee in support of the grounds for appeal;
c) Members of the Appeal Committee ill be able to question the Chair of the
Disciplinar Committee and the appellant;
d) n addition, the Appeal Committee ma call an member of staff as a itness to
clarif or provide advice on an issue.
e) The Chair of the Disciplinar Committee ill then sum up;
f) The appellant ill then sum up;
g) The Chair of the Disciplinar Committee and the appellant ill then leave the
room.

9.8 The Committee ill require the attendance of the appellant (together ith an
friend). Ho ever, none of the appeal proceedings ill be invalidated or postponed b
reason of the absence of the appellant provided that the hearing takes place ithin
the published timescale and the appellant has been given five orking da s notice of
the date and time of the hearing. The Appeal Committee ma e ercise its discretion
to adjourn the hearing at an time.

9.9 The Appeal Committee ill deliberate on the appeal and come to a decision. The
Appeal Committee ma reject the appeal or uphold the appeal. Where the Appeal
Committee upholds the appeal, the Committee ma order one or more of the
follo ing measures:
i) modif or reverse the finding of the Disciplinar Committee;
ii) modif or reverse the order of the Disciplinar Committee. The decision of the
Appeal Committee shall be final.

9.10 The decision of the Appeal Committee shall be communicated to the appellant,
in riting, ithin three orking da s of having been made.

9.11 The Appeal Committee shall have absolute discretion to regulate its o n
procedures, subject to keeping ithin the spirit of this procedure, ith po er to var
or adapt its procedures.

APPEND X A: EXAMPLES OF BREACHES OF THE CODE OF CONDUCT
The follo ing e emplifies the behaviour and conduct hich ould constitute a
breach of the Student Code of Conduct, although not e clusivel :

a) Disruption of the academic, administrative, recreational, social, or other
activities of the School.
b) Obstruction of the functions, duties or activities of an student, member of
staff or other emplo ee of the School or an authorised visitor to the School.
c) Behaviour hich restricts the legitimate freedom of speech, ideas, actions,
or inquir of an other student or member of staff.
d) Behaviour hich is in breach of School regulations on health and safet ,
smoking, or eating and drinking on School premises.
e) Behaviour hich brings the School into disrepute            including antisocial
behaviour in and around the student residence.
f) Violent, indecent, disorderl , threatening or offensive behaviour or language
   hilst on School premises or engaged in an School activit .
g) Malicious damage to School propert         hich includes inter alia, the hall of
residence, School managed propert , Students Union propert or the
propert of an student, member of staff or visitor.
h) Conduct, including the possession or use of drugs or other illegal substance,
   hich constitutes a criminal offence, here that conduct:
a) took place on School or School managed propert , or
b) affected or concerned other members of the School communit , individuals
or groups in related School organisations or partner institutions and
organisations, or
c) damages the good name of the School, or
d) is an offence of dishonest ,          here the student holds an office of
responsibilit in the School, or
e) poses a danger to other members, or to the good order, of the School
communit .

DEF N T ONS
A person subjects another to discrimination and harassment here the engage in
un anted and un arranted conduct hich has the purpose or effect of:
   Violating another person s dignit , or
   Creating an intimidating, hostile, degrading, humiliating or offensive environment
   for another person. The recipient does not need to have e plicitl stated that the
   behaviour as un anted.

2. Bull ing is a form of harassment and ma be characterised as offensive,
intimidating, malicious, or insulting behaviour, or a misuse of po er through means
intended to undermine, humiliate, denigrate or injure the recipient.

3. Victimisation is hen one individual treats another badl or subjects him/her/them
to a detriment because of a complaint about discrimination, harassment or bull ing
or have participated in an investigation, or because the have helped someone ho
has been a victim of discrimination, harassment or bull ing. FONACT regards
victimisation as misconduct.

4. Under this Code of Conduct unacceptable behaviour, hether intentional or not,
can take a variet of different forms. The follo ing descriptions are not e haustive,

   ridiculing or undermining an individual or fostering hatred and/or prejudice

    gnoring, disparaging, or ridiculing a person because of mistaken assumptions
   about their capabilities, or making offensive reference to an individual s

   Controlling or coercive behaviour, such as pressure to subscribe to a particular
   political or religious belief;
   Offensive gestures, language, gossip or jokes;
    nsulting or abusive behaviour or comments;

   pictures or other material, or the transmitting of an such messages or images
   via e-mail or instant messaging;
    ntentional isolation or e clusion;
   Humiliating or demeaning behaviour and/or persistent criticism.

5. Online harassment ma take the form of intimidating, offensive, or graphic posts
on social media sites or chat rooms, or communications b email, te t, or instant
messaging.

6. Se ual misconduct includes the follo ing, hether or not ithin a se ual or
romantic relationship, including here consent to some form of se ual activit has
been given and then ithdra n, or if consent has been given on previous occasions:

   Se ual intercourse or engaging in a se ual act ithout consent;
   Attempting to engage in se ual intercourse or engaging in a se ual act                                       ithout
   consent; sharing private
   se ual materials of another person ithout consent;
   Kissing ithout consent;
   Touching inappropriatel through clothes ithout consent;
    nappropriatel sho ing se ual organs to another person;
   Repeatedl follo ing another person ithout good reason;
   Making un anted remarks of a se ual nature.
