RÉUNION DU COLLÈGE: l'UE propose de mettre sur la liste noire les opérateurs de transport
qui contribuent à faciliter le trafic de migrants ou la traite des êtres humains
Dans le cadre de la réaction de l'Union européenne à l'instrumentalisation d'êtres humains par un
État tiers à la frontière extérieure de l'UE avec la Biélorussie, la Commission et le haut représentant
proposent aujourd'hui des mesures visant à prévenir et à restreindre les activités des opérateurs de
transport qui pratiquent ou facilitent le trafic de migrants ou la traite des êtres humains à destination
de l'UE. Il s'agit d'un nouvel instrument qui viendra s'ajouter à la boîte à outils dont l'UE dispose
pour soutenir les États membres touchés par des attaques hybrides de ce type. D'autres formes de
soutien, dont l'aide humanitaire, devraient accompagner toute mesure prise en vertu de cet
instrument. La présidente de la Commission européenne, Ursula von der Leyen, a déclaré à cette
occasion : « Les tentatives visant à déstabiliser l'UE en instrumentalisant des êtres humains ne
fonctionneront pas. L'Union agit ensemble et prend diverses mesures pour résoudre la situation à nos
frontières extérieures avec la Biélorussie. Nous présentons une nouvelle proposition visant à mettre
sur liste noire les opérateurs de transport impliqués dans le trafic de migrants ou la traite des êtres
humains à destination de l'UE, comme je l'ai annoncé pour la première fois il y a deux semaines.
Jamais nous n'accepterons que des êtres humains soient exploités à des fins politiques. »
Aujourd'hui, la Commission met aussi à disposition 200 millions d'euros supplémentaires aux fins de
la gestion des frontières pour soutenir la Lettonie, la Lituanie et la Pologne. Par ailleurs, la
Commission travaille sur une proposition sur des mesures provisoires dans le domaine de l'asile et
du retour, fondée sur l'article 78, paragraphe 3, du Traité sur le fonctionnement de l'UE. Cette
démarche fait suite à l'invitation du Conseil européen à la Commission de proposer tout changement
nécessaire au cadre juridique de l'UE et des mesures concrètes afin d'assurer une réponse immédiate
et appropriée conformément au droit de l'UE et aux obligations internationales. Elle répond
également à une demande des États membres touchés de pouvoir recourir à des mesures provisoires
pour faire face efficacement à la situation migratoire d'urgence aux frontières de l'UE. Vous trouverez

Commerce et sécurité: la Commission met en avant les travaux visant à défendre les
intérêts et les valeurs de l'UE
La Commission européenne présente aujourd'hui les principales conclusions relatives à la défense
des intérêts de l'UE en ce qui concerne le contrôle des exportations et les investissements étrangers
dans l'UE. La Commission a procédé au filtrage de 400 investissements étrangers depuis l'entrée en
vigueur de la nouvelle législation relative au filtrage des investissements directs étrangers (IDE).
Bien qu'il n'existe que depuis un an, ce mécanisme a été adopté de manière impressionnante, ce qui
signifie que les intérêts de l'UE seront mieux protégés à l'avenir. Dans le même temps, plus de 30
000 demandes d'exportation de biens susceptibles d'être utilisés à des fins militaires ont été
examinées par les États membres dans le cadre du régime de contrôle des exportations de l'UE, dont
603 ont été bloquées. Ce sont là quelques-uns des faits marquants annoncés à l'occasion de la
publication des premiers rapports sur le filtrage des IDE et sur le contrôle des exportations. Valdis
Dombrovskis, vice-président exécutif et commissaire chargé du commerce, a déclaré: « L'UE reste
ouverte au commerce et aux investissements étrangers — il s'agit d'un pilier de la création d'emplois
et de la croissance économique. Mais notre ouverture n'est pas inconditionnelle et doit être
compensée par des outils appropriés pour préserver notre sécurité et notre ordre public. Le filtrage
des investissements étrangers et le contrôle des exportations de biens à double usage contribuent à
préserver la sécurité de l'UE tout en protégeant les droits de l'homme. Elles sont des éléments
essentiels de notre politique commerciale ouverte, durable et ferme. Ces deux rapports soulignent
comment ces outils peuvent aider la Commission et les autorités compétentes des États membres à

agir avec détermination lorsque la situation l'exige, en défendant nos intérêts tout en promouvant

Les Européens expriment un fort soutien aux droits et principes numériques*
La Commission publie aujourd'hui les résultats de la consultation publique sur un ensemble de droits
et de principes numériques. Ils montrent un large soutien aux valeurs proposées par l'UE dans
l'espace numérique. Ces principes vont de l'internet à haut débit pour tous à un environnement en
ligne ouvert, sûr et fiable, en passant par le plein accès aux compétences et à l'éducation
numériques ainsi que la garantie de la protection des enfants et des jeunes en ligne. Margrethe
Vestager, vice-présidente exécutive pour une Europe adaptée à l'ère numérique, a déclaré : « Les
réponses à la consultation montrent un large soutien et un intérêt pour un espace numérique centré
sur l'humain. Elles sont précieuses pour la future déclaration sur les principes numériques qui devrait
faire référence au fait que la technologie renforce le pouvoir d'action des gens. » Le commissaire
chargé du marché intérieur, Thierry Breton, a ajouté : « Les citoyens européens veulent se sentir
protégés et en contrôle lorsqu'ils sont en ligne. C'est ce que signifie pour eux la transformation
numérique : contrôler leurs données, savoir à quoi ils peuvent s'attendre lorsqu'ils vont en ligne,
disposer des aptitudes et des compétences nécessaires pour faire des choix éclairés. Ces éléments
tirés de la consultation paneuropéenne que nous avons menée alimenteront nos travaux sur une
déclaration européenne des droits et principes numériques. » Les réponses indiquent un soutien à la
définition de principes basés sur des valeurs européennes, telles que la pluralité, l'inclusion, la non-
discrimination, l'ouverture, la vie privée, la démocratie et la durabilité. Trois participants sur quatre
étaient un citoyen ou une organisation de la société civile, mais des organisations professionnelles et
des autorités publiques ont également apporté leur contribution. Les résultats de la consultation
alimenteront une proposition de déclaration européenne des droits et principes numériques que la

Fight against human trafficking: High-level meeting of the United Nations General Assembly
Yesterday evening, Commissioner for Home Affairs, Ylva Johansson, spoke on behalf of the EU and
Member States at the plenary of the high-level meeting of the General Assembly on the appraisal of
the United Nations Global Plan of Action to Combat Trafficking in Persons. The two-day meeting is an
opportunity to assess achievements, gaps and challenges in the implementation of the Global Plan of
Action to Combat Trafficking in Persons. The EU Anti-Trafficking coordinator, Diane Schmitt, is also
participating on behalf of the EU to discuss the Global Plan of Action and enduring trafficking issues
and gaps including the trafficking of women and children, particularly the trafficking of girls for the

Agriculture: the Commission approves new geographical indication from Portugal
The Commission has today approved the addition of ‘Alho da Graciosa' from Portugal in the register
of Protected Geographical Indication (PGI). ‘Alho da Graciosa' is the garlic grown in the island of
Graciosa, in the Azores archipelago. It is presented in the form of dried bulbs, either individually or
in braids, each with a diameter of at least 3 cm. ‘Alho da Graciosa' is characterised by its medium
low intensity aroma and its intense, very pleasant flavour with little aftertaste, which are due not
only to the island's soil and climatic conditions but also to the care taken by the producers over the
years. Graciosa has always been known as the Terra do Alho (garlic country) and garlic is pictured on
the coat of arms of one of the most iconic parishes on the island, the parish of São Mateus. The new
denomination will be added to the list of 1566 products already protected in the eAmbrosia

17e réunion ministérielle UE-Asie centrale : relever les défis dans les perspectives
Le haut représentant/vice-président Josep Borrell et la commissaire chargée des partenariats
internationaux, Jutta Urpilainen, ont participé à la 17e réunion ministérielle UE-Asie centrale qui
s'est tenue hier à Douchanbé, au Tadjikistan. Dans un communiqué de presse conjoint, les

participants ont confirmé leur volonté de renforcer la coopération entre l'UE et l'Asie centrale afin de
soutenir une reprise verte et durable après la COVID-19 et de coopérer pour relever certains des
défis découlant de l'évolution de la situation en Afghanistan. Le haut représentant Borrell a déclaré:
« Les pays d'Asie centrale ont accompli des progrès remarquables depuis leur indépendance il y a 30
ans. L'UE a un grand intérêt à voir l'Asie centrale se développer comme un espace économique et
politique plus résilient, plus prospère et plus étroitement interconnecté. L'UE et l'Asie centrale sont
fermement déterminées à intensifier leur coopération afin de mieux reconstruire à la suite de la
pandémie de la COVID-19. Nous souhaitons également intensifier les efforts conjoints pour gérer
certains des défis communs découlant de la situation en Afghanistan. L'UE peut apporter une
contribution importante à l'avenir de la région si les États d'Asie centrale font preuve de
détermination dans leur engagement en faveur des réformes et de la démocratie. » La commissaire

Antitrust: Commission carries out unannounced inspections in the defence sector
On 23 November 2021, the European Commission is conducting unannounced inspections at the
premises of a company active in the defence sector. The Commission has concerns that the inspected
company may have violated EU antitrust rules that prohibit cartels and restrictive business practices
(Article 101 of the Treaty of the Functioning of the European Union). The Commission officials were
accompanied by a counterpart from the relevant national competition authority. Unannounced
inspections are a preliminary step in an investigation into suspected anticompetitive practices. The
fact that the Commission carries out such inspections does not mean that the company is guilty of
anti-competitive behaviour nor does it prejudge the outcome of the investigation itself. The
Commission fully respects the rights of defence in its antitrust proceedings, in particular the right of
companies to be heard. There is no legal deadline to complete inquiries into anticompetitive conduct.

Mergers: Commission clears acquisition of Imperial Logistics by DP World
The European Commission has approved, under the EU Merger Regulation, the acquisition of sole
control of Imperial Logistics Limited of South Africa by DP World Limited of the United Arab Emirates.
Imperial Logistics is a transport and logistics supplier in various African countries and a provider of
contract logistics and freight services in the European Economic Area and the UK. DP World is active
in port terminal operations, maritime services, free trade zones, cargo handling and logistics services
worldwide. The Commission concluded that the proposed acquisition would raise no competition
concerns given its limited impact on the market. The transaction was examined under the simplified

Mergers: Commission clears acquisition of joint control of Scotia Gas Networks by OTPP,
Brookfield and OMERS
The European Commission has approved, under the EU Merger Regulation, the acquisition of joint
control of Scotia Gas Networks (‘SGN') of the UK by OTTP, Brookfield and OMERS, all three of
Canada. SGN is the second largest gas distribution network in the UK. OTTP is active in the
investment of pension plan assets. Brookfield is a global asset manager. OMERS is active in the
investment and administration of pensions. The Commission concluded that the proposed acquisition
would raise no competition concerns, given that SGN's activities will be limited to the UK and that it
will have no activities in the European Economic Area. The transaction was examined under the

Mergers: Commission clears creation of joint venture by Liberty Global and InfraVia
The European Commission has approved, under the EU Merger Regulation, the creation of Liberty
Networks Germany (‘LNG'), a new joint venture based in Germany, by Liberty Global plc of the UK
and InfraVia V Invest S.à.r.l. of Luxembourg. LNG will establish and provide fibre-to-the-home
internet services in rural districts of several States (‘Länder') in Germany. Liberty Global owns and
operates cable networks offering television, broadband internet, fixed-line voice telephony and
mobile telecommunications services in several EU Member States. InfraVia is a management
company of investment funds specialised in the infrastructure and technology sectors. The
Commission concluded that the proposed acquisition would raise no competition concerns, as the
transaction only gives rise to minor potential vertical links between the activities of the companies.

APPOINTMENTS

COLLEGE MEETING: The European Commission appoints a new Head of Representation in
Slovakia
Today, Vladimír Šucha has been appointed as Head of the European Commission's Representation in
Bratislava and will take office on 1 January 2022. In this function, he will act as the official
representative of the European Commission in Slovakia under the political authority of President
Ursula von der Leyen. Mr Šucha, a Slovak national, is endowed with robust experience in managing
senior teams and is also well versed in a range of EU policies. Combined with his many years of
involvement in European and Slovakian diplomacy, his background makes him particularly suitable
to effectively manage key political relations as well as communication and strategic coordination
related tasks as Head of Representation. Since early 2021, Vladimír Šucha has been a Senior Policy
Adviser at the United Nations Educational, Scientific and Cultural Organization (UNESCO), where he
is primarily focused on developing a global system for using the scientific knowledge to support the
management of societal changes. He has been working for the European Commission for 15 years,
including as Hors Classe Adviser in the Directorate-General for Education and Culture (EAC) in 2020,
Director-General of the Joint Research Centre (JRC) from 2014 until 2019 and Director in DG EAC
from 2006 until 2012. Before joining the Commission in 2006, Mr Šucha was Director of the Slovak
Research and Development Agency, Principal Advisor for European Affairs to the Slovak Minister of
Research and Education and also worked as a diplomat at the Slovak Permanent Representation to

COLLEGE MEETING: The European Commission appoints a Hors Classe Adviser for its
budget department
The European Commission has decided today to appoint Siegfried Ruhl as Hors Classe Adviser to the
Directorate-General for Budget (BUDG). Mr Ruhl has extensive experience in public finance, notably
international debt capital markets, and in developing funding strategies. Combined with his proven
negotiation skills, these factors make him a highly suitable candidate to continue providing strategic
advice on the implementation and possible evolution of the EU's diversified funding strategy to raise
up to around €800 billion (in current prices) for NextGenerationEU. Siegfried Ruhl, a German
national, has been seconded to the European Commission since October 2020, as a Counsellor to the
Director-General of DG BUDG. Prior to that, he was the Head of Funding and Investor Relations at
the European Stability Mechanism (ESM) and was responsible for the management of €300 billion of
outstanding debt. He was in charge of executing auctions, syndications and private placements, and
managing funding related derivatives transaction. He was also steering the communication and
relationship with more than 1,600 investors. Mr Ruhl joined the ESM in January 2013, after leading
the division that established the funding programme for the European Financial Stability Facility
(EFSF) at the Bundesrepublik Deutschland Finanzagentur. Earlier in his career, he worked as a trader
at the Bundesrepublik Deutschland Finanzagentur for 11 years and at the Deutsche Bundesbank for
six years. Via the latter engagement, which was the first step in his career as a trader at the financial

markets, he also worked at the Frankfurt Stock Exchange. Siegfried Ruhl holds a degree in Business

Innovation community gathers at the European Innovation Council Summit in Brussels
The European Innovation Council Summit will take place in Brussels on 24 and 25 November,
bringing together innovators, researchers, entrepreneurs, investors and many more from across
Europe to discuss about the future of European innovation policy. The Summit also aims to facilitate
coaching, networking and the exchange of ideas for high-growth start-ups, giving the opportunity to
European start-ups and innovators to connect and network with other small and medium businesses,
researchers and investors. Margrethe Vestager, Executive Vice-President for a Europe Fit for the
Digital Age, and Mariya Gabriel, Commissioner for Innovation, Research, Culture, Education and
Youth, will open the event with two keynote speeches highlighting the achievements of the European
Innovation Council (EIC) and its unique investment approach that supports the deep technologies
that will change Europe's future for the better. Thierry Breton, Commissioner for the Internal
Market, will participate in the session on technological sovereignty, where he will stress the
importance of Europe laying the foundations of technological leadership to accelerate and anticipate
our shift towards a greener and more digital economy, while ensuring Europe's resilience. During the
EIC Summit, the Commission will present several initiatives and will announce the new edition of the
EIC Impact report and key achievements (will be online on 24 November at 14:00 CET), as well as
the winners of three EIC Prizes: the European Capital of Innovation Awards, EU Prize for Women
Innovators and the European Innovation Procurement Awards. The newly elected members of the
EIC Board will also be presented and Commissioner Gabriel will launch the EIC Forum, a platform
aimed at bringing together innovation actors at the EU, national and regional level, to ensure a

Commissioner Várhelyi on official visit to Bosnia and Herzegovina
Commissioner for Neighbourhood and Enlargement, Olivér Várhelyi, will be travelling to Bosnia and
Herzegovina on 24 and 25 November to pursue political dialogue with the country's leaders as part of
the EU's efforts to de-escalate the situation and help relaunch the European agenda, so that Bosnia
and Herzegovina moves forward on its EU path. Commissioner Várhelyi will meet representatives of
State and entity institutions, including the Trio Presidency and political leaders in Sarajevo, Banja
Luka and Mostar. The EU has been consistently calling on political leaders to refrain from
destabilising unilateral actions and divisive rhetoric and to refocus on the implementations of 14 key
priorities required for Bosnia and Herzegovina to progress on its European path, including full
functioning of State institutions and advancing with constitutional and electoral reforms. EbS will
