Public Meeting This public meeting is a requirement of the Planning Act and is being held to provide an opportunity for the public to voice their comments and concerns with regards to the proposed amendment to the Zoning By-Law. If a person or public body would otherwise have an ability to appeal the decision of the Township of Champlain to the Local Planning Appeal Tribunal (LPAT) but the person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Champlain before the by-law is passed, the person or public body is not entitled to appeal the decision. A person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Board, there are reasonable grounds to do so. 22
Application Scope • This zoning by-law amendment proposes to change the zoning category for the property located at 868 Pleasant Corner Road , from from “Rural Zone” with aggregate reserve (RU-ar) to “Rural Special Exception Zone” with aggregate reserve (RU-56-ar) and (RU-57-ar). • The first “Rural Special Exception Zone” (RU-56-ar) is required in order to allow agricultural uses (namely a silo and grain bin) to remain on site as part of a hobby farm. The second “Rural Special Exception Zone” (RU-57-ar) is required in order to remove residential uses on the adjacent lands. • The proposed bylaw amendment was a condition of severance. Analysis Provincial Policy Statement (2020) The 2020 Provincial Policy Statement (PPS) provides direction on rural lands and aggregate lands. • 1.1.5 Rural Lands in Municipalities • 1.1.5.4 Development that is compatible with the rural landscape and can be sustained by rural service levels should be promoted. • 1.1.5.7 Opportunities to support a diversified rural economy should be promoted by protecting agricultural and other resource-related uses and directing non-related development to areas where it will minimize constraints on these uses. 25
Analysis Provincial Policy Statement (2020) The 2020 Provincial Policy Statement (PPS) provides direction on rural lands and aggregate lands. • 2.5 Mineral Aggregate Resources • 2.5.1 Mineral aggregate resources shall be protected for long-term use and, where provincial information is available, deposits of mineral aggregate resources shall be identified. • 2.5.2.5 In known deposits of mineral aggregate resources and on adjacent lands, development and activities which would preclude or hinder the establishment of new operations or access to the resources shall only be permitted if: • a) resource use would not be feasible; or • b) the proposed land use or development serves a greater long-term public interest; and • c) issues of public health, public safety and environmental 26 impact are addressed.
Analysis United Counties of Prescott and Russell (UCPR) Official Plan 2.5.2 The Rural Policy Area is composed of lands which are located outside of the primary development and agricultural resource areas, that is to say lands which are outside of the Urban Policy Area and Community Policy Area and the Trade and Industry Policy Area and the Agricultural Resource Policy Area. Lands which are subject to the Mineral Aggregate Resources policies of Part IV and/or the Natural Heritage policies of Part V and or the Public Health and Safety policies of Part VI may be designated “Rural Policy Area”, but development, or certain uses, may be constrained or prohibited. Public Meeting This public meeting is a requirement of the Planning Act and is being held to provide an opportunity for the public to voice their comments and concerns with regards to the proposed amendment to the Zoning By-Law. If a person or public body would otherwise have an ability to appeal the decision of the Township of Champlain to the Local Planning Appeal Tribunal (LPAT) but the person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Champlain before the by-law is passed, the person or public body is not entitled to appeal the decision. A person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Board, there are reasonable grounds to do so. 35

Analysis Township of Champlain Zoning By-Law Existing Zoning – “RMHP - wf” – Residential Mobile Home Park Mobile Home Park shall mean a lot developed and managed under single or corporate ownership, which has been planned, divided into mobile home sites, improved and provided with water and sewer services approved by the Ministry of the Environment for the placement of exclusively mobile homes for permanent or seasonal residential use. Proposed Zoning “RR- wf” - Rural Residential Is a rural residential zone which allows for the construction of single detached dwellings and other low density residential uses in rural areas on 1 acre lots (4000m2). Special Provision – “WF” Where a zone classification is followed by the symbol "wf", the lands in question have been determined, by geotechnical investigation, to have development constraints relating to unstable slopes.
