         The EU Biocidal Products Regulation
                   (BPR 528/2012)
 • On making available on the market and use of biocidal
   products
 • Nitrogen is included in the list for its asphyxiating properties
   ➢ Restrictions of use for human health and environmental
       safety
 • Applicable from 1/09/2013; latest version: 2014
 • Biocidal products must be submitted for assessment (use,
   safety, etc) by 1 September 2017 (art. 93)
    ➢ Mandatory licencing of any product containing nitrogen
 • Belgium: KB 4/04/2019

         • NO heritage institution did submit any request for
           in-situ nitrogen generators assessment
         • Only commercial companies submitted a request
           for assessment
          ➢ Heritage institutions cannot use any more
            their anoxic facilities to treat their collection
            agains pests
          ➢ Commercial companies have a de facto
            monopolistic position

     • no damage to the heritage
     • not harmful for humans or environment)
N2   ➢ But canisters of nitrogen is NOT the solution
     • expensive > not used by small museums
     • dangerous to use and transport (gaz @ -196°C under
       pressure)
     • commercial companies don’t have skills in all kinds of heritage
     • commercial companies may decide in 2021 not to renew their
       licence

Tax Shelter
• STUDIE door Universiteit Antwerpen onder leiding
  van prof. Annick Schramme en prof. Dirk De Corte
• Initiatief vanwege
  – ICOM Vlaanderen
  – ICOM Wallonie Bruxelles
  – Brusselse Museumraad

•   Tax shelter is a tax measure that can make the creation of artistic productions fiscally more
    favourable. The rule already exists for audiovisual productions and the performing arts. In
    general, the measure is experienced as successful. That is why other sectors are also asking
    whether the measure can be applied to the museum sector.

•   Twelve museums were invited to participate. Simulations were made on the basis of their
    budgets.

•   The focus was on temporary exhibitions in which tax shelter can then be seen as a form of
    project financing. In all probability, the permanent collection cannot be considered.

•   Every project must have a 'creation component', so it must be clear that a new work is being
    created or that it is a reinterpretation of an existing work.

Stages immersifs pour responsables politiques

Buts:
➢sensibiliser les politiciens et les responsables administratifs
 de la culture à la réalité des musées, leur travail effectif
 dans les domaines de l’éducation, de la conservation, de la
 restauration et de la recherche.

➢Permettre au travers de cette sensibilisation une meilleur
 compréhension des différentes missions des musées afin
 de les soutenir dans leurs demandes lors de débats ou
 d’arbitrages (budget, moyens, diffusion, etc).

Five months after Kyoto, we still don’t know which
exact methodology will be adopted by the Executive
Board in order to proceed with this critical analysis
and hopefully come to one or several final proposals
to be again considered in a future EGA. The Executive
Board met on December for the first time after
Kyoto, and consider on what to do.

Several National Committees, FRANCE, AUSTRIA, GERMANY, did address
letters to the President and members of the Executive Board, claiming for a
new methodology of discussion and maybe for a distinction between
“museum definition” and “prospects and potentials”.

The first dimension to consider as a statutory matter essentially. The other
ones, linked to “mission” and “vision” and so preferably to consider as part of
a revision of the Code of Ethics and, more appropriately, as a possible future
formal declaration of ICOM on the role of museums in contemporary
societies. Reference is also being made to the advantage of adopting new
organizational frames for the discussion, with new actors and deeper
involvement of National and International Committees, as ICOFOM for
instance.
